What is a guardianship and custudy?
The guardianship and custody of the children implies the daily care of the minors, that is, who takes them to and picks them up from school or who accompanies them to the doctor’s check-ups, who is in charge of helping them with their homework and, in short, who is in charge of attending and taking care of the children and managing the daily actions of the minors.

The guardianship and custody of minors can be exercised in our legal system
Sole custody and guardianship
The custodial parent will be in charge of the daily care of the children while a visitation regime will be agreed in favor of the other parent.
Shared custody and guardianship
Both parents will be in charge of the daily care of the children, establishing a regime of stays, normally every other week.

Likewise, and depending on the custody regime that is agreed, other measures related to the children will be established, such as alimony or the right to use the family home, or economic measures such as, for example, compensatory pension or compensatory pension provided for in article 1438 of the Civil Code.
