This may require:<\/p>\n<ul>\n<li>Identifying the deceased\u2019s assets, rights and debts.<\/li>\n<li>Previously winding up the matrimonial property regime.<\/li>\n<li>Valuing the assets forming part of the estate.<\/li>\n<li>Calculating each heir\u2019s share.<\/li>\n<li>Taking account of forced heirship rights, legacies and testamentary provisions.<\/li>\n<li>Carrying out, where applicable, collation or reduction of gifts.<\/li>\n<\/ul>\n<p>As a general rule, no co-heir is required to remain indefinitely in co-ownership and may request the partition of the estate, subject to the limitations established by law.<\/p>\n<p>&nbsp;<\/p>\n<h2 id=\"partition-document\">What is a partition document?<\/h2>\n<p>The <strong>partition document<\/strong> is the instrument recording the operations required to distribute the estate.<\/p>\n<p>It usually contains:<\/p>\n<ol>\n<li><strong>The inventory:<\/strong> a list of the assets, rights and debts forming part of the estate.<\/li>\n<li><strong>The valuation:<\/strong> the financial valuation of the inventoried assets and rights.<\/li>\n<li><strong>The liquidation:<\/strong> the calculation of the net estate available for distribution after taking account of debts, liabilities and any other necessary operations.<\/li>\n<li><strong>Determination of each heir\u2019s entitlement:<\/strong> the calculation of the value corresponding to each heir according to their share of the estate.<\/li>\n<li><strong>Formation of lots:<\/strong> the grouping of assets or rights intended to satisfy each heir\u2019s entitlement.<\/li>\n<li><strong>Allocation:<\/strong> the specific assignment of each asset, right or lot to a particular heir.<\/li>\n<\/ol>\n<p>The exact content will depend on the composition of the estate, the terms of the will and the personal circumstances of the heirs.<\/p>\n<p>&nbsp;<\/p>\n<h2 id=\"types-of-partition\">What types of estate partition are there?<\/h2>\n<p>The partition may be carried out in different ways, depending on the deceased\u2019s instructions and on whether the interested parties can reach an agreement.<\/p>\n<h3>Partition carried out by the testator<\/h3>\n<p>The testator may distribute their assets in the will or through another legally permitted act. In that case, the partition must be respected, provided that it does not prejudice forced heirship rights or breach other mandatory succession rules.<\/p>\n<h3>Partition by a testamentary executor appointed to divide the estate<\/h3>\n<p>The testator may appoint a person to carry out the division and allocation of the estate after their death.<\/p>\n<p>The <strong>testamentary partitioner<\/strong> may carry out the partition without obtaining the unanimous agreement of the heirs, provided that they act within the powers granted to them and comply with the will and succession law.<\/p>\n<h3>Amicable partition between the heirs<\/h3>\n<p>Where the testator has neither divided the estate nor appointed a partitioner, adult heirs with full legal capacity to manage their assets may distribute the estate in the manner they consider appropriate.<\/p>\n<p>As a general rule, this method requires the <strong>agreement of all co-heirs<\/strong> taking part in the partition.<\/p>\n<p>An amicable partition is usually faster and less expensive than a judicial division, but it requires agreement on the inventory, valuations and allocations.<\/p>\n<h3>Partition by a court- or notary-appointed partitioner<\/h3>\n<p>Where the testator has not appointed a partitioner, a notary or the court clerk may appoint a <strong>dative partitioner<\/strong>.<\/p>\n<p>The application must be made by heirs and legatees representing at least <strong>50% of the estate<\/strong>, with notice being given to the other interested parties whose addresses are known.<\/p>\n<p>The partition carried out by the dative partitioner requires approval by the notary or the court clerk, unless it is expressly confirmed by all heirs and legatees.<\/p>\n<h3>Judicial partition<\/h3>\n<p>Where no agreement can be reached and the estate is not to be divided by a partitioner or another person authorised to do so, any co-heir or legatee entitled to a proportional share may apply for judicial division.<\/p>\n<p>The proceedings may include the preparation of an inventory, the appointment of experts and a partitioner, the preparation of the division operations and the resolution of any objections raised by the interested parties.<\/p>\n<p>&nbsp;<\/p>\n<h2 id=\"no-agreement\">What happens if the heirs cannot reach an agreement?<\/h2>\n<p>A lack of unanimity prevents an amicable partition, but it does not necessarily mean that the estate must remain undivided.<\/p>\n<p>Depending on the circumstances, the interested parties may:<\/p>\n<ul>\n<li>Negotiate a different valuation or distribution proposal.<\/li>\n<li>Request the appointment of a dative partitioner if the legally required percentage is met.<\/li>\n<li>Apply for judicial division of the estate.<\/li>\n<\/ul>\n<p>Judicial division usually involves more time and expense. Before commencing proceedings, it may therefore be advisable to identify the precise points of disagreement, such as whether an asset should be included in the inventory, its valuation, the composition of the lots or the allocation of a particular asset to a particular heir.<\/p>\n<p>&nbsp;<\/p>\n<h2 id=\"difference-allocation\">Difference between partition and allocation of an estate<\/h2>\n<p>Partition and allocation are related concepts, but they are not the same.<\/p>\n<p>The <strong>partition<\/strong> includes all the operations required to divide the estate, such as preparing the inventory, valuing the assets, carrying out the liquidation, calculating the shares and forming the lots.<\/p>\n<p>The <strong>allocation<\/strong> is the specific operation through which ownership of particular assets or rights is assigned to each heir.<\/p>\n<p>Allocation therefore usually constitutes the final stage of the partition process.<\/p>\n<p>&nbsp;<\/p>\n<h2 id=\"real-estate\">What happens if the estate includes real property?<\/h2>\n<p>Where houses, land or other real property are allocated, the partition operations are usually formalised in a <strong>public deed of acceptance and allocation of inheritance<\/strong>.<\/p>\n<p>The public deed provides evidence of the allocations and allows the heirs to apply for registration in the Land Registry.<\/p>\n<p>To formalise the deed, it will generally be necessary to provide documents including the death certificate, the certificate of last wills, the will or declaration of heirs, documents relating to the assets and evidence that the relevant taxes have been filed or paid.<\/p>\n<p>&nbsp;<\/p>\n<h2 id=\"debts\">What happens to the debts of the estate?<\/h2>\n<p>Any debts must be taken into account before calculating the net estate available for distribution.<\/p>\n<p>The heirs\u2019 liability will depend on how they have accepted the inheritance:<\/p>\n<ul>\n<li><strong>Unconditional acceptance:<\/strong> the heir is liable for the estate\u2019s debts not only with the inherited assets, but also with their own personal assets.<\/li>\n<li><strong>Acceptance under benefit of inventory:<\/strong> liability is generally limited to the value of the assets forming part of the estate, provided that the legal requirements and formalities are observed.<\/li>\n<\/ul>\n<p>Acceptance under benefit of inventory makes it possible to keep the estate separate from the heir\u2019s personal assets. Failure to comply with the required formalities may result in the loss of this protection.<\/p>\n<p>In addition, the partition does not prejudice the rights of the estate\u2019s creditors, who retain the legal remedies available to claim payment of their debts.<\/p>\n<p>&nbsp;<\/p>\n<h2 id=\"challenge\">Can the partition of an estate be challenged?<\/h2>\n<p>Yes. A partition may be challenged where there is a legal ground for doing so, for example:<\/p>\n<ul>\n<li>The omission of an heir.<\/li>\n<li>The inclusion of a person who is not entitled to inherit.<\/li>\n<li>A breach of forced heirship rights.<\/li>\n<li>A defect in consent.<\/li>\n<li>Failure to comply with the testator\u2019s instructions.<\/li>\n<li>Financial prejudice in the circumstances established by the Spanish Civil Code.<\/li>\n<\/ul>\n<p>The legal consequences will depend on the ground of challenge.
