A declaration of separate property concerns one identified asset. It does not, by itself, change the matrimonial property regime or divide the couple’s assets.

The issue often arises under the sociedad de gananciales, the Spanish community-of-acquisitions regime. Article 1361 of the Civil Code creates a presumption that assets existing during the marriage are community assets unless separate character is proved. A spouse’s admission may help prove that a particular acquisition was funded with the other spouse’s separate resources.

What Article 1324 does—and does not—do

Article 1324 states that, in order to prove between spouses that particular assets belong exclusively to one of them, the other spouse’s admission is sufficient. The same provision adds an important qualification: the admission alone does not prejudice the forced heirs of the spouse who made it, nor creditors of the community or of either spouse.

For that reason, the declaration is not an all-purpose title that conclusively determines ownership against everyone. It may be recorded in an acquisition deed and reflected in the Land Registry as property acquired “by confession”, but the source of funds, the wording of the deed and the wider legal context remain important.

Why heirs and creditors still matter

If the spouse who made the admission later dies, forced heirs are not bound merely because the admission exists. Depending on the facts, the succession, the applicable regional civil law and the act to be registered, their intervention or consent may be required. Article 95.4 of the Mortgage Regulation contains a specific registry rule for property whose separate character results only from the other spouse’s confession.

Creditors are also protected. A declaration cannot be used simply to remove assets from the reach of the community’s creditors or either spouse’s creditors. If the transaction is in reality a gratuitous transfer or a different attribution agreement, its legal cause, formal requirements and the rules protecting legitimate shares and creditors must be analysed separately.

When a property is described as separate “by confession”, the decisive question is not only what the deed says. The origin of the funds, the matrimonial regime, the position of heirs and creditors, and the intended registry act all need to be considered together.

A practical example

Suppose that a married couple is subject to sociedad de gananciales. One spouse buys a flat and the other spouse states in the purchase deed that the price came from the buyer’s separate inheritance. That statement is strong evidence between the spouses that the flat is separate property. It does not automatically prevent later review by the confessor’s forced heirs or creditors, particularly if the confessor has died or the asset is to be transferred or mortgaged.

Frequently asked questions

Is a declaration of separate property the same as a separation-of-assets agreement?

No. A confesión de privatividad addresses one asset. A separation-of-assets regime governs the spouses’ property relationship more broadly and is normally arranged through the appropriate matrimonial property agreement.

Does the declaration automatically make the asset separate for every purpose?

No. It is effective evidence between spouses, but Article 1324 expressly preserves the position of forced heirs and creditors. The Land Registry entry, the source of funds and the planned transaction can all matter.

Can the issue arise after divorce?

Yes. Divorce may end the matrimonial property regime, but liquidation, succession and registry questions can remain. In a 2025 resolution concerning the registration of inherited property acquired as separate by confession, the Directorate-General confirmed that the prior divorce did not remove the registry implications of Article 95.4 where the confessor had died.

We help clients identify the relevant regime, review acquisition documents and coordinate the family, succession and property aspects of the case—especially where an international element or a future sale is involved.

Request a consultation

Related content

This concept is different from the overall joint property system and from separation of assets.
