Its dissolution marks the point at which the regime stops operating for the future. It does not itself identify every community asset, pay debts, transfer title to a house or distribute money between the spouses.

This distinction matters because English-language descriptions often use “community property” broadly. The applicable regime may instead be separation of assets, participation, a regional civil-law regime or a regime selected through a marriage agreement. The following explanation concerns the Civil Code rules on sociedad de gananciales.

When does the regime end?

Article 1392 of the Civil Code provides that the regime ends when the marriage is dissolved or declared void, when legal separation is granted, or when the spouses validly agree to another matrimonial property regime. A divorce may therefore be one cause, but it is not the only one.

Article 1393 also permits judicial dissolution at the request of one spouse in defined situations, such as certain support measures, absence, insolvency, serious unilateral management that threatens the other spouse’s rights, qualifying de facto separation or repeated failure to provide economic information. For judicial dissolution, Article 1394 provides that its effects run from the court decision. The date and effect of dissolution must always be assessed in the context of the relevant cause and documents.

Dissolution, liquidation and division are different stages

Stage

Spanish term

Main function

Dissolution

Disolución or conclusión

Ends the matrimonial regime and opens the liquidation stage.

Liquidation

Liquidación

Builds an inventory, identifies assets and liabilities, pays debts and addresses reimbursements or credits.

Division / award

División / adjudicación

Allocates the net remainder to the spouses or their heirs, sometimes with cash equalisation or a registry step.

Articles 1396 to 1403 regulate the liquidation process. Once the common debts, reimbursements and indemnities have been addressed, Article 1404 provides that the net community estate is divided equally between the spouses or their respective heirs. That is not an automatic 50/50 transfer of each item on the date of dissolution.

A practical sequence

A sensible analysis begins by identifying the actual matrimonial regime and the legally relevant cause and date of dissolution. The next steps are to preserve evidence, prepare an inventory, classify assets and liabilities, address common debts and possible reimbursements, and only then agree or determine the awards. A property may require a notarial deed, a court decision, a registry application or an equalisation payment before the final allocation is complete.

In a divorce or succession, it is often the unfinished liquidation—not the dissolution itself—that creates the practical dispute about a home, a business, debts or money in an account.

Frequently asked questions

Does divorce automatically divide the assets?

No. Divorce may dissolve the regime, but dissolution and liquidation are distinct. The inventory, debts, reimbursements and final awards may still need to be resolved.

Are all assets acquired during marriage community assets?

Not necessarily. Classification depends on the applicable regime, the source and timing of acquisition, any replacement of separate funds, agreements and available evidence.

Does the surviving spouse automatically receive half of every asset?

The net community estate is divided after the liquidation process. That is different from an immediate division of every individual asset and may interact with succession rights, debts and property registration.

At Zabalgo Family Lawyers, we help clients separate the family, property, succession and international-law questions that can become entangled when a matrimonial regime ends.

Request a consultation

Related content

See also our explanation of the joint property system, separation of assets, marriage agreements, divorce in Spain and inheritance and succession.

Official legal source

The Spanish Civil Code’s section on dissolution and liquidation of sociedad de gananciales is available in the official BOE consolidated text, especially Articles 1392 to 1410.
