It does not set a universal maintenance amount or replace the national law that determines entitlement and quantum.

Contents

Scope of the Regulation

Which court may deal with the case?

Applicable law

Recognition and enforcement

Practical information to gather

Frequently asked questions

What does the Regulation cover?

The Regulation applies to maintenance obligations arising from a family relationship, parentage, marriage or affinity. It can be relevant to child maintenance and to maintenance between spouses or former spouses, but the legal character of a particular payment must be assessed under the applicable law.

It is a cross-border procedural and conflict-of-laws instrument. It does not calculate maintenance, decide every issue of parentage, divorce or parental responsibility, or resolve matrimonial property matters. Those issues can be connected to a maintenance case, but they may be governed by different rules.

Important territorial point. The EU framework must be applied with care where Denmark, the United Kingdom or another non-EU country is involved. Denmark participates under a special arrangement and is not bound by the 2007 Hague Protocol. UK and other third-country cases may require analysis under Hague instruments, bilateral arrangements and domestic law.

Which court may have jurisdiction?

Article 3 contains the principal connecting factors. A claim may be brought before the court of the defendant’s habitual residence or the maintenance creditor’s habitual residence. It may also be dealt with by a court hearing a related status case, such as divorce, or a parental-responsibility case, within the Regulation’s conditions.

The Regulation also contains more specific rules on choice-of-court agreements, appearance before a court, subsidiary jurisdiction and exceptional jurisdiction where proceedings cannot reasonably be brought elsewhere. “Habitual residence” is a legal connecting factor; it is not simply a postal address or a nationality.

Which law determines the maintenance question?

Article 15 refers applicable-law questions to the 2007 Hague Protocol on the Law Applicable to Maintenance Obligations. The court with jurisdiction may therefore need to apply the law designated by that Protocol. Jurisdiction and applicable law are separate questions: a Spanish court may have jurisdiction without Spanish substantive law necessarily governing the maintenance issue.

Entitlement, amount, duration, variation and arrears require the applicable law to be applied to verified facts. No maintenance figure can be calculated from this page.

Recognition, enforcement and Central Authorities

The Regulation is designed to help qualifying decisions, court settlements and authentic instruments circulate across borders. The route depends on the state of origin, the relevant Hague Protocol status and the type of instrument. Recognition is not a new hearing on the merits, but it does not remove the need for the correct decision, certificate, translation where required and enforcement procedure in the state where recovery is sought.

Central Authorities play a practical role by receiving and transmitting certain applications and helping to facilitate cooperation. The European e-Justice Portal provides current information about national authorities and forms.

What information should be gathered first?

For a Spain-related cross-border enquiry, it is useful to collect the parties’ and any child’s habitual-residence history, relationship and parentage documentation, existing divorce or maintenance decisions, payment and arrears information, the issuing authority, evidence of the debtor’s likely assets or employment, and all available translations. These facts help determine jurisdiction, applicable law, the recognition route and the competent enforcement authority.

International maintenance cases are not resolved by a single rule. The country involved, the date, the type of family relationship, the existing decision and the debtor’s assets can all change the route that is available.

We advise on Spain-related international family cases, including the preliminary analysis of jurisdiction, applicable law and the recognition or enforcement of a foreign decision.

Request a consultation

Frequently asked questions

Does the Regulation decide which court can hear a cross-border maintenance claim?

It contains jurisdiction rules, but the answer depends on the parties’ residence, any related proceedings and the specific connection relied upon. The correct court should be checked before starting a claim.

Does the Regulation itself determine the law applicable to maintenance?

Not by a single automatic rule for every case. Article 15 refers participating Member States to the 2007 Hague Protocol for applicable-law questions, so the international links and the countries involved must be identified first.

Is a maintenance decision from another country automatically enforceable in Spain?

Not in every case. The origin of the decision, the applicable chapter of the Regulation, the certificate and any enforcement requirements must be reviewed before steps are taken in Spain.

Related content

For the wider cross-border context, visit our International Family Law page.
