A Practical Guide to Probate, Apostille and Translation

A will signed outside Spain can often be used in a Spanish succession. The question is not answered only by where it was signed. The applicable succession law, the will’s formal validity, the evidence of later wills, foreign probate documents, authentication, translation and the Spanish notarial or registry step each serve a different purpose.

For an estate with assets in Spain, separating those questions at the outset helps prevent an avoidable mistake: treating a foreign will, a probate grant and a Spanish deed of acceptance as if they did the same job. They do not.

In this article

Which law governs the succession

Formal validity and the 1961 Hague Convention

Using two wills without creating a conflict

Probate, last-will certificates and foreign documents

Apostille, legalisation and translation

A practical order of work

Frequently asked questions

Which law governs the succession?

For many cross-border successions dealt with in Spain, the starting point is the EU Succession Regulation. Its general rule is that the law of the country where the deceased had their habitual residence at death governs the succession as a whole. In exceptional cases, the facts may show a manifestly closer connection with another country. A person may also choose the law of their nationality in a will, provided that choice is made in the required form.

That is the substantive-law question. It can affect who inherits, the shares of heirs, restrictions on testamentary freedom, acceptance or waiver, and the administration and division of the estate. It is therefore unsafe to assume that a Spanish property, by itself, makes Spanish succession law applicable.

Where the applicable law is that of a country with more than one territorial succession system, the answer is not simply “UK law”. Article 36 of Regulation 650/2012 first refers to that country’s own internal conflict rules. If those rules do not identify the relevant territorial unit, the Regulation uses the deceased’s habitual residence, closest connection or the location of the relevant connecting factor, depending on the issue. That is why England and Wales, Scotland and Northern Ireland should not be treated as interchangeable.

Formal validity and the 1961 Hague Convention

The law governing the succession and the form of a will are separate questions. Spain and the United Kingdom are both Contracting States to the 1961 Hague Convention on the Conflicts of Laws Relating to the Form of Testamentary Dispositions. Under its Article 1, a will can be formally valid if it complies with the internal law of, among other alternatives, the place where it was made, the testator’s nationality, domicile or habitual residence at the relevant time, or—regarding immovable property—the place where the property is situated.

This flexible rule is why a foreign will may be capable of use in Spain without being re-made before a Spanish notary. It does not mean that every foreign document will be accepted without review. The will’s execution, witnesses, revocation, any later will and the law governing the estate can still matter.

The relationship between the European Regulation and the Convention is important. Article 75 of Regulation 650/2012 provides that Contracting States, including Spain, continue to apply the 1961 Hague Convention instead of Article 27 of the Regulation for the formal validity of wills and joint wills.

Can two wills work together?

They can, but only if they are planned as a single arrangement. A person with assets in Spain and another country may make a Spanish will limited to Spanish assets and keep a separate will for assets elsewhere. The wording, applicable law and sequence of both documents must be checked together.

The practical risk is a broad revocation clause. A later will that says it revokes all earlier wills can conflict with, or defeat, the intended two-will structure. Before relying on separate wills, the adviser should review every existing will and codicil, identify which law governs revocation and ensure that each document describes its intended scope consistently.

Probate, last-will certificates and foreign documents

In England and Wales, probate is the legal right to deal with a person’s property, money and possessions after death. A grant of probate can be important evidence that a will has been admitted to probate and that a personal representative has authority in its country of origin. It does not, by itself, resolve every Spanish issue about applicable law, beneficiaries or the documents required to deal with Spanish assets.

Document

What it can establish

What still needs checking in Spain

Foreign will or certified copy

The terms of the testamentary disposition.

Formal validity, later wills, applicable law and the authority of the copy.

Grant of probate or equivalent authority document

The status or powers established in the issuing jurisdiction.

Its effect for the Spanish notarial deed, registry and the individual asset.

Spanish Certificate of Last Wills

Whether a will was made in Spain and before which notary.

Whether a foreign wills registry or equivalent evidence must also be obtained, if it exists.

European Certificate of Succession

Specified succession status, rights or powers for cross-border use in participating EU States.

Whether it is useful for the transaction; it is optional and does not replace every national document.

In Spain, the Certificate of Last Wills identifies whether the deceased made a Spanish will and before which notary, so that a person with inheritance rights can obtain an authorised copy of the latest will. Where the deceased had an overseas connection, a comparable certificate or search from the foreign jurisdiction may also be relevant if that system provides one. It should be identified before assuming that the will already in hand is the final testamentary document.

For foreign public documents, Articles 56 and 57 of Law 29/2015 form part of the Spanish framework. Article 57 allows Spanish notaries and public officials, where necessary for the execution of a foreign public document, to adapt an institution unknown to Spanish law to an equivalent Spanish institution with comparable effects, aims and interests. This is not automatic recognition; it is a legal assessment of the document and the transaction.

Apostille, legalisation and translation

An apostille is not a stamp that validates a will’s contents or decides who inherits. It authenticates the origin of a qualifying public document: the signature, the capacity in which the signatory acted and, where appropriate, the seal or stamp. A privately held original will is not automatically an apostillable public document merely because it exists.

Issue to check

Why it matters

Practical question

Type of document

An official copy, probate grant, court order or notarial act may follow a different route from a private original will.

What is the exact document the Spanish notary, registry or authority requires?

Apostille or legalisation

The correct route depends on the issuing country, the document and applicable treaty rules.

Is the issuing State linked to Spain through the Apostille Convention for this document?

Translation

The receiving Spanish authority must be able to understand and rely on the document.

Is a sworn Spanish translation required for the recipient and the document’s purpose?

Authentication and translation solve different problems. An apostille may establish the origin of a qualifying public document; a sworn translation addresses the language in which the Spanish authority receives it. One does not replace the other.

Spanish notarial and registry steps

Where Spanish assets must be transferred and there is no dispute, the usual route often involves a Spanish notarial deed recording acceptance and allocation of the inheritance. The notary will assess the foreign will, the applicable succession law, the identity and powers of any executor or personal representative, the heirs’ entitlement and the Spanish assets.

For Spanish real estate, the Property Registry performs its own registration assessment. A valid foreign will does not itself transfer registered title. The registrable title and the supporting documentary route must meet the Spanish registry framework for the individual case.

A practical order of work

Step

What to do

Why it comes first

1. The applicable succession law, the will’s formal validity, the required evidence and the Spanish notarial and registry route must be considered together.

Can I have one will for Spain and another for my home country?

It can be possible, but both documents must be reviewed together. A general revocation clause or inconsistent choice-of-law wording can create a conflict, so separate wills should not be assessed in isolation.

Does probate replace the Spanish inheritance deed?

No. A foreign probate grant may be important evidence of status or authority in its issuing jurisdiction, but it does not automatically replace the Spanish deed or the requirements for dealing with a Spanish asset.

Can a European Certificate of Succession replace a will?

No. It is an optional cross-border EU document that can evidence specified status, rights or powers in another participating Member State. It does not replace a will or every national document.
