A home in Spain is the obvious example, but the analysis is not limited to property: Spanish Inheritance and Gift Tax can also be relevant to other assets and rights connected with Spain.

The first priority is usually time. For non-resident cases handled by the State Tax Administration Agency (AEAT), the return is normally made on Form 650. The legal and tax position then needs to be mapped carefully: the deceased’s residence, the beneficiary’s residence, the assets, the relevant region and the family relationship may all matter. This article is a practical starting point, not a tax calculation or a substitute for advice on a particular estate.

In this article

When Spanish inheritance tax can apply

Form 650 and the six-month deadline

Requesting an extension

Regional rules for non-residents

Double taxation: a separate question

Municipal capital gains tax

Facts to review before quoting a figure

A practical filing sequence

Frequently asked questions

Does Spanish inheritance tax apply to a non-resident?

A non-resident beneficiary can be subject to Spanish Inheritance and Gift Tax on assets and rights that are located in Spain, can be exercised in Spain or must be performed in Spain. The statute also includes certain life-insurance payments connected with Spanish insurers or contracts made in Spain. This is commonly described as taxation by real liability. The exact classification of an asset and the facts of the case should be checked before filing. Spanish Inheritance and Gift Tax Act, article 7.

That is different from the position of someone habitually resident in Spain. A Spanish habitual resident is generally taxed by personal liability, regardless of where the relevant assets or rights are located. Residence is therefore important, but it is not the only connecting factor in a cross-border succession. Spanish Inheritance and Gift Tax Act, article 6.

A useful practical rule is not to assume that living abroad removes the Spanish filing question. Start by listing the estate assets and identifying which ones may be within the Spanish tax net.

Form 650: the deadline to put in the diary

For inheritances and relevant life-insurance payments on death, the AEAT’s non-resident Form 650 guidance sets a filing period of six months from the date of death. If there is a declaration of death, the period runs from the date on which that declaration becomes final.

The person who acquires the inheritance or legacy is generally the taxpayer. In practice, each beneficiary’s position, acquisition and supporting documents should be reviewed rather than treating the family as a single filer. The AEAT also identifies the heir or legatee as the person required to file in an inheritance case. AEAT FAQ for non-residents.

Do not leave the filing plan until the last weeks. In many non-resident inheritances, an NIE (foreigners’ identification number) is needed in practice for the Spanish tax filing and for notarial or registry steps. It is sensible to apply for it early. A person outside Spain may apply through a Spanish consular office; the National Police indicates a maximum five-day period to decide once the application has entered the competent register. National Police: NIE assignment.

Foreign death certificates, wills, apostilles, translations, asset evidence, powers of attorney and proof of values can also take time to organise. A death certificate issued by one EU Member State for use in another may fall within the scope of Regulation (EU) 2016/1191, which removes the apostille requirement for covered public documents. It does not cover every estate document, decide the legal effect of a foreign will or remove every translation issue.

If the deceased was foreign, the Spanish file may also require the Spanish certificate of last wills and, where the country concerned has an equivalent record, evidence of the most recent foreign will. Read our guide on using a foreign will in Spain.

Can the six-month deadline be extended?

Yes, but the timing matters. The AEAT states that a single extension for a period equal to the ordinary filing period may be requested. In an inheritance case, this means an extension of up to six months, requested within the first five months of the filing period. AEAT deadline guidance.

The regulations provide further detail. The request may be made by heirs, executors or estate administrators and should contain the prescribed information, including the death certificate, the known or presumed heirs, their relationship with the deceased, an approximate description and value of the assets, and the grounds for the request. If no decision is notified within one month of a timely application, the extension is deemed granted. A request made after the first five months cannot be granted under this rule. Inheritance and Gift Tax Regulations, article 68.

An extension is not a cost-free pause. The regulations provide that a granted extension carries late-payment interest from the end of the original six-month period until the return is filed. It is sensible to consider the request, the tax filing and any payment or deferral issues as related—but distinct—steps. Do not assume that one request resolves all of them. AEAT FAQ for non-residents.

Regional rules: why the location can change the analysis

Inheritance and Gift Tax is a State tax, but Spain’s Autonomous Communities may regulate important elements in their own rules. In the common-regime communities, their powers can cover reductions, the tax scale, pre-existing-wealth amounts and coefficients, and deductions or credits. That is why an answer based only on a national headline rate can be misleading. Organic Law on the Financing of Autonomous Communities, article 48.

For cross-border inheritances, the connection is not simply “the region where the heir lives.” Under the special statutory rules:

if the deceased was not resident in Spain, the relevant regional rules may be those of the Autonomous Community where the Spanish assets in the estate have their greatest value;

if the deceased was resident in a Spanish Autonomous Community, a non-resident beneficiary may be entitled to apply that community’s rules.

These are legal connection rules, not automatic tax outcomes. The statutory wording, the actual asset values and location, and the status of each person in the succession must be checked. There may also be a different framework in the Basque Country or Navarre, which have their own fiscal arrangements. Inheritance and Gift Tax Act, Additional Provision 2; AEAT: State/Autonomous Community division of competence.

For a beneficiary living outside the European Union or European Economic Area, this point is particularly important. A person may, in the required form, choose the law of a country whose nationality they hold. Crucially, the Regulation does not apply to revenue or tax matters. A choice of succession law is therefore not, by itself, a choice of Spanish inheritance-tax treatment. Regulation (EU) No 650/2012, articles 1, 21 and 22.

This distinction matters before documents are signed or assets are distributed. A succession may be governed by one country’s civil law while Spain still applies its own tax rules to a Spanish asset or right.

Could the same inheritance be taxed in Spain and another country?

Potentially, yes. A country of residence or another country connected with the estate may tax the same succession under its own rules while Spain taxes Spanish assets or rights. Spanish domestic relief should not be assumed: Article 23 of the Spanish Inheritance and Gift Tax Act grants its international double-taxation deduction where Spanish tax is charged by personal liability, not as a general deduction for a non-resident taxed in Spain by real liability.

Any relief has to be checked under the relevant international agreement, if one applies, and under the tax rules of the country concerned. The same estate can therefore require coordinated Spanish and foreign tax advice; filing or paying in one country does not automatically resolve the other country’s position.

Municipal capital gains tax on Spanish property

If the estate includes urban land in Spain, municipal capital gains tax (Impuesto sobre el Incremento de Valor de los Terrenos de Naturaleza Urbana, often called plusvalía municipal) should be checked separately from inheritance tax. On an acquisition on death, the statutory filing period is six months from the taxable event and may be extended to one year at the taxpayer’s request.
