Accepting a Spain-connected inheritance from abroad can be complex. The key is coordinating documents, the civil decision, tax filing and registration in the right order.

This guide gives a practical sequence for an heir abroad. The route may change where several countries, a surviving spouse, a dispute, unknown debts, a minor or uncertainty over the governing law are involved.

Start by establishing the succession

Before signing or appointing someone to act, confirm the date and place of death, the deceased’s habitual residence and nationality, whether a will exists, and who may inherit.

In an international estate, the law governing civil succession may need separate analysis. The EU Succession Regulation concerns civil-law succession, not revenue matters. Its general rule refers to habitual residence, while it permits a choice of the law of nationality in defined circumstances.

Obtain the death certificate first. The General Administration of Spain states that a Spanish last-wills certificate cannot be requested until 15 business days after death, excluding the day of death, weekends and public holidays. It indicates whether a Spanish will was made and identifies the relevant notary.

If a death abroad is not recorded at the Spanish Central Civil Registry or relevant consulate, check the formalities required for the foreign certificate by the issuing country and the Spanish authority receiving it. A Hague Apostille is normally used between states party to the Apostille Convention. A document issued elsewhere may require the applicable diplomatic or consular legalisation. Defined EU documents, and documents issued under the EU Succession Regulation, may be exempt from legalisation in the circumstances set by those instruments; this is not a blanket exemption for every inheritance document. A Spanish sworn translation may also be required.

What to obtain or confirm Why it matters Points to check from abroad
Death certificate Starting evidence of the death. Depending on the document, the country of issue and the receiving authority, formalities and a Spanish sworn translation may be required.
Spanish last-wills certificate Shows whether a Spanish will exists and identifies the notary. Observe the 15-business-day waiting period.
Will, or declaration of heirs Identifies the succession route and persons called to inherit. Check the applicable formalities and translation requirements for foreign documents.
Identity, family-status, residence and nationality evidence Helps establish entitlement. Keep originals and certified copies available.

For the non-resident Form 650 route, the Spanish Tax Agency lists the death certificate, last-wills certificate, and will or declaration of heirs as mandatory documents. It also requests an inheritance acceptance deed or, if unavailable, a detailed inventory of assets and heirs.

Prepare the inventory before deciding how to accept

Prepare a fact-based inventory of Spanish property and rights, known liabilities, charges, potentially deductible expenses, and supporting records. It ensures that the civil documents and tax information describe the same estate.

For Spanish real property, collect title material, current Land Registry information and an IBI receipt where available. Obtain current evidence for other assets. Record mortgages, loans and other known obligations as carefully as assets. Form 650 guidance calls for values at death and claimed charges, debts and expenses; property documentation may also be needed.

Resolve uncertainty over a property’s value, a debt or an heir’s identity before a deed or tax return presents it as settled. A rushed inventory can create notarial, tax or registry inconsistencies.

Obtain the document that proves entitlement

The document trail must show the death and succession entitlement. If there is a Spanish will, the last-wills certificate directs the interested person to the notary for an authorised copy. If not, an intestate declaration of heirs may be needed under the relevant law.

Some cross-border cases may use a European Certificate of Succession where the Regulation applies. The Tax Agency states that an authentic copy proving heir or legatee status may replace the death certificate and will or declaration of heirs for Form 650. A Spanish translation is required if it is not in Spanish. Its availability should be assessed on the estate’s facts.

Foreign public documents require particular care. The Spanish Ministry of Justice explains that an apostille certifies the signature’s authenticity and the issuer’s capacity; it does not decide every substantive succession question.

Attend, appoint a representative, or use both

Living abroad does not automatically mean travelling to Spain for every task. The option depends on the action, documents and requirements of the notary, tax authority, bank or Land Registry.

A tailored authority may help with documents, tax communications, filing and, where appropriate, a civil instrument. It should identify the intended acts. Authority for tax communications does not automatically authorise acceptance, division of the estate or later disposal of an asset. Check its wording against the intended act before signature.

For tax purposes, a non-resident taxpayer subject to the real-obligation regime who is not resident in an EU or qualifying EEA state must appoint a person or legal entity resident in Spain before the tax authority. A person resident in an EU or qualifying EEA state is not required to appoint a Spain-resident representative, although general legal or voluntary representation may still be used. Check residence and the current mutual-assistance position in the individual case.

Route What it may help with What to confirm first
Attend in Spain Discussion with the notary and signing where required. Who attends, required originals, and whether civil documents are ready.
Appoint a representative Defined administrative, tax or civil acts for the heir. Scope of authority, formalities for Spain, apostille or legalisation, translation and acceptance by the recipient.
Use the electronic Form 650 route Tax filing without travelling to the National Tax Management Office. Identification method, authority to act, supporting documents and whether this is the competent route.

The Tax Agency provides an electronic Form 650 route for this procedure. A separate self-assessment is obtained for each taxpayer, with the succession document and supporting documents. Electronic filing does not answer whether an heir has accepted or repudiated the inheritance.

Keep the civil decision and tax calendar aligned

A tax return is not a substitute for the civil decision, and waiting for civil issues does not automatically stop the tax filing clock.

Under the Spanish Civil Code, acceptance and repudiation are voluntary and free acts. Where it governs, an interested person can use the notarial procedure in article 1005 to require a decision within 30 calendar days. The notice gives the options of outright acceptance, acceptance under benefit of inventory, or repudiation. Without a declaration, the inheritance is treated as accepted outright.

This is distinct from the inheritance-tax filing deadline. For the Tax Agency’s non-resident Form 650 procedure, the deadline for a death acquisition is six months from the date of death, or from the date on which a declaration of death becomes final. An extension for a period equal to the original filing period can be requested within the first five months. If the Tax Agency does not notify a decision within one month after a properly filed request, the extension is deemed granted. The extension starts when the original six-month period ends and statutory late-payment interest accrues until the return or document is filed.

Workstream Immediate question Time point to diarise
Civil succession Who is entitled, which law applies, and what decision is being considered? A notarial notice may trigger its own 30-calendar-day period where article 1005 applies.
Tax filing Is the non-resident Form 650 route applicable, and who files for each taxpayer? Six months from death or a final declaration of death; an extension request must be made within the first five months.
Municipal capital gains tax on urban land (plusvalía municipal) Does the inheritance give rise to this local tax, and what procedure applies under the relevant town council’s rules? Normally six months from the date of death; the period can be extended to one year if the taxpayer requests it.
Registration What title and tax evidence will support the requested entry? Prepare early, but submit only when documentation is coherent and complete. Where the inheritance document gives rise to plusvalía municipal, proof that the required local filing has been made will be needed before registration.

Where Spanish civil law applies, the benefit of inventory is subject to strict formalities and may involve short deadlines. An heir who has possession of estate assets must notify a notary and request a notarial inventory within 30 days of learning that they are an heir. If the heir has neither possession nor acted as heir, different starting points apply. In other circumstances, the option may remain open for longer. Missing the applicable formalities or deadline can result in an outright acceptance, so obtain advice promptly if estate debts are uncertain. This does not affect the separate tax timetable.

File and register when the documents are ready

The Form 650 guidance discussed here is the Tax Agency’s non-resident procedure. It covers, among others, non-resident natural persons inheriting Spanish assets or rights, but the competent authority, filing route and tax treatment depend on the facts. For the State non-resident Form 650 route, filing is made with the Spanish Tax Agency. That does not necessarily mean that the State tax rules determine the tax. A non-resident heir may be entitled to apply a Spanish autonomous community’s inheritance-tax rules: if the deceased was resident in a Spanish region, the rules of that region may apply; if the deceased was non-resident, the relevant region is generally the one where the Spanish assets and rights in the estate have their highest value. The applicable regional rules can materially affect the tax result and should be checked before filing.

Before submission, reconcile names, dates, heir identification, asset descriptions and values across the inventory, civil documents and tax return. If a document is pending, assess promptly whether an extension request may be appropriate under the official rules.

Registration is a separate stage, not an automatic consequence of being named in a will. For Spanish real property, the Land Registry will assess the title and supporting evidence. Where the inheritance document gives rise to municipal capital gains tax on urban land (plusvalía municipal), the Land Registry will require proof that the required declaration, self-assessment or other legally prescribed filing has been made before registration.

Prepare the succession title, tax evidence and property documentation as one coordinated file. The result will depend on the registrar’s review of the documents and the facts of the individual case.

A concise checklist for heirs abroad

  • Record the date of death and diarise the six-month Form 650 tax deadline.
  • Check whether the inheritance gives rise to municipal capital gains tax on urban land (plusvalía municipal); if it does, confirm the relevant town council’s procedure and filing deadline.
  • Obtain the death certificate and, after the waiting period, the Spanish last-wills certificate.
  • Obtain the will or, where applicable, begin the declaration-of-heirs route.
  • Check the formalities and translation requirements for each foreign document with the relevant authority.
  • Build a documented inventory of assets, liabilities and supporting records.
  • Confirm the law governing the civil succession before making an acceptance decision.
  • Check the tax route, the potentially applicable autonomous-community tax rules and, if relevant, whether an extension request is needed within the first five months.

Frequently asked questions

Can I accept a Spanish inheritance without travelling to Spain?

It may be possible to use a representative for defined steps, and the Tax Agency describes an electronic filing route for its non-resident Form 650 procedure. Whether an acceptance or notarial act can be signed through a representative depends on the scope and form of the authority and the receiving authority’s requirements.

Is the six-month deadline the deadline to accept the inheritance?

No. In the Tax Agency’s non-resident Form 650 procedure, six months is the tax filing period measured from death or a final declaration of death. Civil acceptance timing is separate. Where the Spanish Civil Code applies, a notarial demand under article 1005 can require a response within 30 calendar days.

Can the six-month tax deadline be extended?

An extension for a period equal to the original filing period can be requested within the first five months. If the Tax Agency does not notify a decision within one month after a properly filed request, the extension is deemed granted. The extension starts when the original six-month period ends and statutory late-payment interest accrues until the return or document is filed.

Do all non-resident heirs need a Spain-resident tax representative?

No. Under the Tax Agency’s guidance, the obligation differs according to the heir’s residence and the applicable EU/EEA mutual-assistance conditions. Non-residents outside the qualifying EU/EEA group are required to appoint a Spain-resident representative for this tax obligation, while qualifying EU/EEA residents are not subject to that specific appointment requirement.
